End User License Agreement (EULA)

This End User License Agreement (“EULA”) governs your use of the video game, application, software, their associated upgrades, patches, and updates and related services (the “Game”) currently provided or which will be provided by Xayba Games, LLC ("Xayba", “we”, “our”, or “us”). This EULA sets out the basis on which we make a Game available to you (“Player”) and on which the Player may use them.

 

1. License Grant

We grant the Player a non-exclusive, non-transferable, non-sublicensed, non-commercial and personal license to install and/or use the Game, for such time until either Player or Xayba terminates this EULA. No ownership rights are transferred.

The Player will not modify, reverse engineer, or redistribute the Game. The Player will not sell or resell the Game or any of its assets. The Player will not circumvent copy protection or upload Game for distribution without our authorization.

 

2. Ownership

All title, ownership rights and intellectual property rights in and to the Game (art, coding, music, brand names and trademarks) remain the exclusive property of Xayba Games, LLC. This license does not grant any ownership interest in the Game.

3. Platform Terms

If Game is distributed through third-party platforms (e.g. Steam), the terms of those platforms apply in addition to this EULA. In case of conflict, platform rules will prevail for platform-specific features.

4. Data Storage

Gameplay data may be stored locally on the Player’s device. If Player utilizes online leaderboard features, high scores will be submitted to the respective platform. We do not collect any personal data.

 

5. Disclaimer & Limitation of Liability

The Game is provided to the Player “as is” with no warranty of any kind. We are not responsible for any indirect, incidental, or consequential damages, including data loss or hardware issues, associated with normal play pattern.

 

6. Termination

The EULA is effective from the earlier of the date Player purchases, downloads or uses the Game, until terminated according to its terms. Violation of this EULA will automatically end the Player’s license. We reserve the right to remove access where permitted by platform rules.

 

7. Changes to this EULA

Xayba reserves the right, in its sole and absolute discretion, to revise, update, change, modify, add to, supplement, or delete certain terms of this EULA for security, legal, best practice, or regulatory reasons.
